Title: Is The Mafia Immune To The Death Penalty?

The question beggars why, in the history of the american Mafia, no Mafia "made guy" has ever been executed by the government. Is it coincidence, surely not, as a long list of wise guys have been charged and convicted of multiple murder. ( in many cases between 2 and 30 killings!!!). I'm not talking about orders for an execution given by a capo or Boss of a given crime family, but the consequent contract given to a soldier(s).
On the hand of the spectrum the states executes convicted killers as a matter of course, unless the death penanlty doesn't apply in a particular state, or due to a pardon, which almost never will be granted. If this critera applies to all judicial cases for first degree murder, why hasn't a Mafioso been given the same treatment as those, who suffered the death penalty for the same crime???
As above stated, any criminal proscecutor in the United States would have had enough ammunition to apply the death penalty to almost every Mafioso accused of a murder, but it seems somehow allien to most people, that the Mafia fraternity always gets sentenced to absurd prison terms, like treble life imprisoment, or 100 years imprisoment. In other words, they can keep on killing, but they have to be aware of the consequences, namely life imprisoment.

A few may have gotten it in period of 1920-1964 (Or 1968) before New York outlawed death penalty. It depends on what state they are in. A lot of people were exectuted for murder before mafia was known to exist. Lepke Buchwalter and 3 others went to electric chair, so there are four for you right there who did get death sentance.
Gravano confessed to 19 murders, but got deal, as do others who rat, so they don't even get much jail time, let alone death penalty.

Thanks Holl. I wasn't sure if death penalty was still on table with him.
Most of Mafia has been in New York, with no death penalty for anyone since 1960's. Another factor is they kill other gangsters, so not much public outcry for victums.

Not anymore. I believe prosecutors would (or have) drop the death sentence against him because he became a witness.

They are just about only guys who get felony time for gambling and other minor crimes, so if prosectors cuould give it they would.

i think its because these guys make deals....maybe if the feds would stop making deals things might change in their favor a lil bit. just my humble opinion

Probably a big part to do with it mobbed up; up there with danmann's point that NY and NJ do not have the death penalty and other jurisdictional issues. Mafia guys are engaged in criminal conspiracies, where as your garden variety serial killer is a lone psycho with nobody to turn on. Lone serial killers have nothing to offer law enforcement; mobsters do.
Also criminal conspiracies are large in scope and long in duration; investigators will still go and talk to mob prisoners after they have been locked up for years. They can offer useful opinions or background information, and more importantly they can be used to corroborate and cross check the validity of new information received.
Same reason the US has not executed spies convicted for espionage since probably the Rosenberg's. They are too useful to counterintelligence; they are always going back to them. Same with captured terrorists.
